
Hi my name is Larry Kimmel I'm the managing partner at Kimmel Carter, a personal injury and workers' compensation firm in the state of Delaware
Today we're going to be talking about car accidents and specifically liability claims that arise from those car accidents Liability claims are the pain and suffering that you are claiming when you are involved in an accident Sometimes it's pain and suffering plus medical bills or lost wages that we call "boardable" or admissible at trial So in a previous video I talked about PIP benefits that cover those medical bills and lost wages from the car that you are in at the time of the accident This is a liability claim for pain and suffering against the person who is at fault in the accident
And we're pursuing that claim against the person who is at fault, oftentimes insured by their insurance company to cover this pain and suffering claim If the medical bills were not paid by PIP, so if they were outside the two year PIP window or PIP benefits have been exhausted, they are called "boardable" or admissible medical bills and lost wages and they are also part of our claim for pain and suffering When we talk about pain and suffering we talk about the extent of the injuries and how much you treated Do you have any permanent injuries? Do you have any permanent restrictions? Do you have any future lost wages? And do you have any future medical expenses? And we look at that complete claim that we're making against the person who is at fault in the accident and we're trying to resolve the claim with the insurance company for that pain and suffering claim If we're unable to do that for a fair value with the authority provided by the client, then we are filing a lawsuit in the state of Delaware, usually in the superior court of Delaware
